Snus

Snus may only be sold commercially if the specific product has FDA marketing authorization; General Snus (Swedish Match) is authorized. Use and personal possession are legal for adults 21+. Federal Tobacco 21 minimum age applies.
Nicotine Pouches

Legal basis: Family Smoking Prevention and Tobacco Control Act 2009; FDA Premarket Tobacco Product Authorization (PMTA)
Nicotine pouches require FDA marketing authorization. On 16 January 2025 the FDA authorized 20 ZYN products (3 mg and 6 mg) β the first nicotine pouch authorization. Other brands operate pending PMTA review. Age 21+ nationwide.
Cigarettes

Cigarettes are legal and regulated by the FDA. Federal minimum purchase age is 21 since December 2019.
Vape / E-cigarettes

Heated Tobacco (IQOS)

Heated tobacco products require FDA authorization. IQOS received marketing (and modified-risk) authorization from the FDA. Age 21+ nationwide.
