Mexico
Last reviewed: 2026-06
Travelling to Mexico with snus or nicotine pouches? Both are unclear in Mexico. Cigarettes are legal for adults aged 18+. This page covers the legal status of snus, nicotine pouches, cigarettes, vaping, and heated tobacco in Mexico as of 2026-06, with official sources where available.
Snus
UnclearLegal basis: Ley General para el Control del Tabaco (2008)
Mexican tobacco law does not specifically address snus. The 2008 law bans products that resemble cigarettes without being tobacco, but smokeless oral tobacco is not clearly covered. Commercial availability is very limited; status is a grey area.
Nicotine Pouches
UnclearLegal basis: Presidential decree 2020/2022; constitutional reform (Arts. 4 & 5, Jan 2025)
Nicotine pouches (tobacco-free) are not explicitly named in Mexico's vape/e-cigarette prohibitions. Their status is a grey area: broad anti-vape decree language may capture them, but they are not clearly banned and are sometimes sold informally. Treat as uncertain.
Cigarettes
LegalMinimum age: 18+
Legal basis: Ley General para el Control del Tabaco (2008, reformed 2021)
Cigarettes are legal but heavily regulated, with a near-total advertising ban, plain-style packaging and health warnings. Minimum purchase age 18.
Vape / E-cigarettes
BannedLegal basis: Constitution Arts. 4 & 5 (reform Dec 2024, effective Jan 2025); 2020 & 2022 presidential decrees
Mexico has a constitutional ban (effective January 2025) on the production, import, distribution, sale and advertising of vapes and e-cigarettes — the first country to embed a vape ban in its constitution. Personal use is not itself criminalized but import and sale are prohibited.
Heated Tobacco (IQOS)
BannedLegal basis: Presidential decrees (2020, 2022); constitutional reform Arts. 4 & 5 (2024/2025)
Heated tobacco products are covered by Mexico's import and commercialization prohibitions on alternative nicotine/vapor systems; import and sale are banned.
